Terms of Service

These Terms of Service (“Terms”) govern access to and use of the hosted phone, texting, and fax services (the “Service”) provided by Two Cans and Some String, Inc. (“TCSS,” “we,” “us”), operating at https://tcss.io. By signing up for, provisioning, or using the Service, you (“Customer,” “you”) agree to these Terms.

1. Agreement to Terms

Creating an account, porting a number to TCSS, or activating any TCSS line, extension, or plan constitutes acceptance of these Terms and of our Acceptable Use Policy, Privacy Policy, and E911 Notice, each incorporated here by reference. If you do not agree, do not use the Service.

2. Description of Service

TCSS provides hosted and on-premise business telephony (Hosted PBX, On-Prem Appliance, Hybrid), business SMS, and online fax, billed at one flat, all-in rate that is stated to include applicable taxes and regulatory recovery fees for the plan as published on https://tcss.io. Plans are month-to-month unless a separate written agreement states otherwise — TCSS does not require an annual contract or early-termination fee for standard plans.

3. Eligibility & Account Registration

You must be at least 18 years old and authorized to bind the business or individual on whose behalf you register. You are responsible for the accuracy of account information, including the registered service address used for 911 routing (see E911 Notice), and for safeguarding credentials to the customer portal.

4. Acceptable Use

Use of the Service is subject to our Acceptable Use Policy, which prohibits fraud, abuse, unlawful robocalling or bulk messaging, and other misuse of calling, texting, and fax capability. We may suspend or terminate service for violations, with notice where practicable.

5. Fees, Billing & Taxes

The price quoted for a TCSS plan is the price billed — published rates include ordinary federal and state telecom taxes and standard regulatory recovery fees applicable to the plan at the time of purchase. Add-on lines, overage (e.g., fax pages or SMS beyond a plan’s pooled allotment), directory assistance, and optional hardware are billed separately and disclosed before purchase. We will provide notice before any price change takes effect on a renewal cycle. Invoices are billed monthly in advance; past-due accounts may be suspended.

6. No Contracts; Cancellation

Standard TCSS plans are month-to-month. You may cancel at any time by contacting sales@tcss.io or through the customer portal; cancellation is effective at the end of the then-current billing cycle. We do not charge an early-termination fee on standard plans. Enterprise agreements with negotiated terms are governed by their signed order form.

7. Number Porting

TCSS will coordinate porting your existing numbers from your prior carrier. Porting timelines depend on the losing carrier and are outside our direct control. You represent that you are authorized to port each number submitted. Your prior service typically remains active until the port completes.

8. Equipment

TCSS may ship phones or adapters pre-configured for the Service. Provisioned equipment remains usable only with a TCSS account unless otherwise agreed. You may instead bring your own SIP-standard compatible equipment; TCSS does not guarantee compatibility with every third-party device.

9. Reasonable Use Policy

“Unlimited” US calling and pooled texting allotments are intended for normal business voice and messaging use by the number of seats or lines on your plan. Use that is disproportionate to a typical business of your plan’s size — including but not limited to auto-dialing, continuous call generation, or bulk messaging inconsistent with 10DLC campaign registration — may be throttled, billed at overage rates, or subject to a request that you move to a plan suited to that volume.

10. Service Availability & 911 Dialing

VoIP 911 dialing works differently than traditional landline 911. Please read the E911 Notice in full, including its explanation of power- and internet-outage limitations and your obligation to keep your registered service address current.

11. Suspension & Termination

We may suspend or terminate the Service for non-payment, violation of these Terms or the Acceptable Use Policy, suspected fraud, or a legal or regulatory requirement, with notice where practicable. You may terminate as described in Section 6.

12. Disclaimers & Limitation of Liability

The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, TCSS disclaims implied warranties of merchantability, fitness for a particular purpose, and non-infringement, and TCSS’s aggregate liability for any claim arising from the Service is limited to the fees paid by you for the affected Service in the three (3) months preceding the claim.

13. Indemnification

You agree to indemnify and hold TCSS harmless from claims arising out of your use of the Service in violation of these Terms, applicable law, or the rights of a third party.

14. Governing Law

These Terms are governed by the laws of the state in which TCSS is organized, without regard to conflict-of- laws principles, and any dispute will be resolved in the courts located in that state, unless a signed Enterprise agreement specifies otherwise.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted here with an updated “last updated” date, and, where required by law, notice will be sent to the account contact on file.
